By downloading, installing, accessing, or using the App, you agree to these Terms. If you do
not agree, do not use the App.
1) Eligibility and Age
The App is intended for users aged 17+. By using the App, you represent that you meet this requirement.
2) Privacy
Your use of the App is subject to our Privacy Policy.
3) License and Permitted Use
3.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for
personal, non-commercial purposes, subject to these Terms.
3.2 Restrictions
- No copying/modifying/distributing/selling/leasing/sublicensing except as permitted by law.
- No reverse engineering except where prohibited by law.
- No disrupting security, networks, or other users.
- No unlawful use or unauthorized access attempts.
4) Accounts
If the App offers account features, you must provide accurate information and safeguard your
credentials. You are responsible for activity under your account.
5) User Content and Collages
You retain ownership of photos and materials you import or upload (if applicable), and the
collages you create. You grant us a limited permission to process your content solely to provide
the Services, as described in the Privacy Policy.
- No facial recognition and no biometrics.
- You are responsible for having rights to your content and not violating third-party rights.
6) Optional Server-Side (Cloud) Processing and AI-Assisted Features (If Enabled)
Some optional features may require uploading images/text to our servers for processing,
including AI-assisted features if offered. Details on handling and deletion are described in the
Privacy Policy.
7) Intellectual Property
The App and its content are owned by or licensed to PistaCycle Team and protected by
intellectual property laws. No rights are granted beyond the license in Section 3.
8) Third-Party Services
You may choose to share/export collages to third-party services. We are not responsible for
third-party services, and your use is governed by their terms and policies.
9) Disclaimers
The App is provided AS IS and AS AVAILABLE without warranties of any kind
to the maximum extent permitted by law.
10) Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special,
consequential, or punitive damages. Our total liability is limited to the amount paid (if any)
in the prior 12 months or USD $50, whichever is greater, unless law requires otherwise.
11) Indemnification
You agree to indemnify and hold harmless PistaCycle Team from claims arising out of your use of
the App, your content, or your violation of these Terms or law.
12) Termination
We may suspend or terminate access if you violate these Terms or for security/legal reasons.
You may stop using the App at any time. Upon termination, your license ends.
13) Changes to the App or Terms
We may modify the App and update these Terms from time to time. Updated Terms are effective when
posted with a new effective date.
14) Governing Law
These Terms are governed by the laws of the jurisdiction of PistaCycle Team’s principal place of
business, without regard to conflict-of-law principles, except where prohibited by applicable law.
15) Dispute Resolution; Binding Arbitration
Please read carefully—this affects your rights.
15.1 Informal Resolution
Before arbitration, contact us at CaydenPanaccione57463@outlook.com to try to resolve the issue informally.
15.2 Binding Arbitration
If unresolved, disputes will be resolved by binding arbitration on an individual basis, except as
required by applicable law. Venue/language/rules will be mutually agreed or determined by the
arbitration provider consistent with law.
15.3 No Class Actions
To the maximum extent permitted by law, disputes must be brought individually, not in class/collective proceedings.
15.4 Injunctive Relief
Either party may seek injunctive/equitable relief to protect intellectual property or confidential information.
16) Miscellaneous
- Severability: If any part is unenforceable, the remainder remains effective.
- Entire Agreement: These Terms and referenced policies form the entire agreement.
- No Waiver: Failure to enforce a provision is not a waiver.
